Do you own an iPhone 6 or 7? If you do, you might be eligible to get up to $150 from Apple as part of a $14-million Canada-wide class-action settlement.

The B.C. lawsuit was originally filed in 2018 against Apple, accusing it of providing software updates that deliberately slowed down, or throttled, older iPhones.

Apple agreed to settle, without admitting any wrongdoing. In March the B.C. Supreme Court approved the class-action settlement.

Here’s what you need to know about the proposed class-action and how eligible iPhone users can file a claim.

What is the class-action lawsuit about?

The proposed class-action lawsuit against Apple Inc. and Apple Canada was filed in B.C., Ontario, Saskatchewan and Alberta, alleging the tech giant concealed performance mitigation features, had defects that caused the phones to prematurely age or degrade or defects in battery performance, which might have led users to purchase a new device sooner than they had planned.

Apple denied the allegations, but has agreed to settle and pay between $11,137,500 and $14,427,500. It said the settlement is not an admission of liability, wrongdoing or fault.

Who is eligible?

Canadian residents (except those in Quebec) as of June 15, 2023 who have owned or purchased an:

• Apple iPhone 6, 6 Plus, 6s, 6s Plus, SE, smartphone device and installed or downloaded iOS 10.2.1 or later before Dec. 21, 2017, or;
• Apple iPhone 7 or 7 Plus smartphone device and installed or downloaded iOS 11.2 or later before Dec. 21, 2017

Quebec residents are not included in the settlement because Quebec has a separate case against Apple.

How much can I receive?

Class members eligible for the payout can expect between $17.50 and $150 for each phone, depending on the number of approved claims and other expenses and fees.

When is the deadline to submit a claim?

Claimants must submit a claim form for each iPhone device by Sept. 2, 2024.

What information is required?

The claim form requires you to provide your name, mailing address, phone number, email address, and your iPhone’s serial number, which can be found in the phone’s settings (Settings > General > About).

If you no longer have the phone, you can check the bar code on the original packaging or the original receipt or invoice.

Claimants will also have to declare under oath that they downloaded or installed a software update on their eligible phones before Dec. 21, 2017 and experienced slowdowns or “diminished performance” on that device after the relevant iOS version was installed.
