Are high-capacity mags going to be banned? ›

As of 2022, twelve U.S. states, and a number of local governments, ban or regulate magazines that they have legally defined as high-capacity. The majority of states do not ban or regulate any magazines on the basis of capacity.

A high-capacity magazine is typically defined as any magazine or drum that is capable of holding more than either 10 or 15 rounds of ammunition. Military-style assault weapons and high-capacity magazines exist only to enact maximum destruction, and there's simply no reason that everyday Americans need access to them.

The idea is not that banning high-capacity magazines (anything more than 10 or 15 rounds) would stop mass shootings. The hope is that it would at least limit the number of people killed when these attacks happen.

It is now settled law that large-capacity magazines are illegal in California. On November 30, 2021, the Ninth Circuit Court of Appeals upheld Penal Code 32310, which bans these devices. The court ruled that the ban does not violate Second Amendment rights.

Magazines holding more than 10 rounds are banned in California. Colorado bans magazines holding more than 15 rounds.

If charged as an infraction, the crime is punishable by a fine not to exceed $100 for each magazine. If charged as a misdemeanor, the crime is punishable by: A fine of up to $100 (per magazine); and/or; A sentence of up to one year in county jail.
