Erika shocked fans—and even her co-stars—when she announced in November 2020 that she and Tom were divorcing. "After much consideration, I have decided to end my marriage to Tom Girardi," she said in a statement to Us Weekly at the time. "This is not a step taken lightly or easily. I have great love and respect for Tom and for our years and the lives we built together. And the Hulu documentary The Housewife and The Hustler raised a lot of questions about all of the scandals surrounding Erika and Tom, including accusations that Tom was embezzling legal settlement funds from his clients. The couple was also accused of staging their divorce to try to protect their assets.
And during The Real Housewives of Beverly Hills season 11 reunion, Erika reveals everything about the true state of her financial affairs.

Tom said in court testimony in the fall that he doesn’t have any money. “At one point I had about 80 million or 50 million in cash. That’s all gone,” he said, per the Los Angeles Times. "I don’t have any money."
Still, Erika previously told Andy Cohen that she and Tom don’t have a prenup, but she doesn’t think it would make a difference if they did. “I’m married to a very powerful lawyer. A prenup wouldn’t stand in his way anyway,” she said at the time. “So it doesn’t matter whether you had one or you didn’t, it’s gonna be all Tom’s way, I assure you.”

In addition to Tom's legal troubles, Erika has now been named in at least half a dozen lawsuits, according to The New York Times, the largest of which is a bankruptcy case. Months ago, lawyers suggested that Tom's law firm may have paid for $25 million of her expenses. In July, Erika was named as a defendant in a suit filed by a bankruptcy trustee trying to collect that money.
Court documents revealed she was spending more than $850,000 on stylists and manicures, at least $1.3 million on marketing, and around $14 million in American Express charges. RHOBH fans know that Erika also has a "glam squad" with her at all times—they've even starred in some episodes.
Older court documents claimed that she knowingly hid money from creditors. "Erika has used her glamour and notoriety to continue to aid and abet in sham transactions that have occurred with respect to large transfers of assets from the Debtor," the files read, per People.
Erika's lawyer, Evan Borges, stated that she had no idea what Tom was accused of or how he handled his law firm's money. “Erika doesn’t have personal liability for any of those transactions,” Borges explained, per the New York Times.
On the June 22 episode of RHOBH, Erika even got drunk (and messy) on a boat, ranting about how her old yacht was named “Illegal,” per Vulture. Sadly, had to get rid of the yacht (among other things) because of her debt.
And what’s this I hear about her fixing her friendship with Sutton Stracke?
Her self-described “fragile” relationship with Stracke may be on the come-up. Though Stracke had allegedly spread rumors about one of the lawsuits Jayne was involved in, they were seen on the June 22 episode joking around about dating apps together, per Entertainment Tonight.
"We're not going to be forced into kumbaya," she told Entertainment Tonight. "Work that out at our own...timing, not everyone else's.”
