Some religious groups were against what they called “sucking sodas” and felt that this activity should be banned on the Sabbath. This ban on Sunday soda sales was a big problem for anyone that enjoyed root beer floats or other ice cream sodas.

According to Dr. James E. Thayer, Pinky's younger brother, the Tin Roof Sundae was named after the tin roof of a livery stable located across the street from the Potter Sundry; however, James also confessed that Pinky liked to pull the leg of his little brother. Pinky Thayer's creation soon became a national sensation.

During the 1890s, blue laws prevented the sale of ice cream sundaes on Sunday because of its popularity and its competition with the Christian sabbath.
