In 2019, the House of Commons' Fixing Fashion Report found that TK Maxx was was one of several companies rated as 'least engaged' in sustainable fashion and labour market initiatives according to Ethical Consumer. In the same year, the American brand had to publicly apologise for racially profiling a customer's child.

TK Maxx keeps its prices low by buying designer products that have been over-produced, or buying excess stock that has been purchased by another retailer at a low price. They can then pass this saving onto the end consumer – in other words, you!
Why is TK Maxx so successful?
TK Maxx believes in creating a treasure hunt experience, so when shoppers find a bargain, they feel like they've earned it. New deliveries come in every day and stores receive an average of 10,000 new products a week.

Zara again scores “Not Good Enough” for labour. Half of its final stage of production is undertaken in Spain, a medium risk country for labour abuse, and the brand received a score of 51-60% in the Fashion Transparency Index.
The brand was also among the first to stock a “Conscious” sustainable fashion collection in its stores. On the other hand, the majority of the materials it uses are not eco-friendly, and the brand still operates under an unsustainable, fast fashion business model.
