Comenity, Kaiser, and Dell Class Action Settlement Checks Mailed (1)According to recent reports, three different class action lawsuits are paying out settlement checks to qualified Class Members. If you are a Class Member of the Comenity Bank TCPA class action settlement, the Kaiser Permanente robocall class action settlement, or the Dell service contract sales tax class action settlement, be on the lookout for settlement checks in the mail, as they should be arriving to you soon.

Comenity Bank TCPA Class Action Settlement

A TCPA class action lawsuit was filed against Comenity Bank—which owns a number of popular store credit cards like Abercrombie and Fitch, Crate & Barrel, Ann Taylor, and Victoria’s Secret just to name a few—alleging the bank placed call to consumers’ cell phones using an automatic telephone dialing system and/or a prerecorded message, both alleged TCPA violations. While Comenity denies all wrongdoing in this TCPA class action lawsuit, the bank agreed to settle in order to avoid the uncertainty of continued litigation and court costs.

The Comenity TCPA class action settlement received final approval May 27. Settlement checks were mailed out within 30 days of final approval, per the terms of the TCPA settlement agreement. If you received a phone call from Comenity Bank that featured either an automatic telephone dialing system or a prerecorded voice message between Aug. 1, 2010, and May 26, 2014, you may soon be receiving your portion of the settlement in the mail for an of estimated sum of $15 to $35.

The Comenity Bank TCPA Class Action Lawsuit is Carrie Couser v. Comenity Bank, Case No. 3:12-cv-02484-MMA-BGS, in the U.S. District Court for the Southern District of California.

Kaiser Permanente Robocall Class Action Settlement

Similar to Comenity, Kaiser Permanente was also hit in a TCPA robocall class action lawsuit, and faced allegations that the healthcare insurance provider had called 864,000 former consumers via unsolicited phone calls and unwanted text messages after they canceled their Kaiser Permanente insurance plan. According to the Kaiser robocall class action lawsuit, the messages from Kaiser asked these former Kaiser consumers to reapply for their health insurance plans.

Kaiser denied violating TCPA statutes, but has agreed to this robocall class action settlement in order to avoid further cost and uncertainty of continued litigation. The health insurance company agreed to pay $5.35 million to establish a Kaiser Permanente TCPA settlement fund, which has reportedly been used to compensate the thousands of former customers bothered by the unwanted phone calls and texts messages.

The proposed Kaiser Permanente robocall class action lawsuit received final approval on May 12, 2015. Checks were mailed out within 30 days of approval, according to the settlement agreement. If you are a Class Member of this particular TCPA class action settlement, you may receive a settlement check in the mail soon.

The Kaiser Permanente Robocall Class Action Lawsuit is Sherman v. Kaiser Foundation Health Plan Inc., Case No.3:13-cv-00981, in the U.S. District Court for the Southern District of California.

Dell Service Contract Sales Tax Class Action Settlement

Two sales tax class action lawsuits were filed against Dell Inc., alleging the computer company illegally charged over 4 million California consumers for state use tax if they purchased certain Optional Service Contracts, and later forwarded these collected taxes to California State Board of Equalization.

Dell denies all allegations in the two service contract sales tax class action lawsuits, but has agreed to settle both cases in order to avoid the uncertainty of future litigation and court costs.

A post on the Dell service contract sales tax class action settlement website states payments are being mailed on a rolling basis as of July 2015. If you bought one or more Dell Optional Service Contracts for Dell computer hardware sold to you between April 8, 1999, and June 30, 2008, that required you to pay California sales taxes on the service contracts, you may soon receive a settlement check with a refund for these allegedly improperly charged taxes.

The Dell Service Contract Sales Tax Class Action Lawsuit is Mohan, et al. v. Dell Inc., et al.,Case Nos. CGC 03-419192; CJC-05-004442, in San Francisco Superior Court.
